MNX SPORTSWEAR’S PRIVACY POLICY

By 25th of May 2018 a new regulation came into effect in the European Union, called regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR). It provides strict and specific guidelines on how personal data is gathered and handled. This also affects companies and individuals that reside outside of the EU but collect data from EU citizens. We want to inform you that our company also respects GDPR regulation.

What personal data do we collect and why?

Personal data is any information that relates to customer and identifies customer personally, either alone or in combination with other information available to us. MNX limits its requests for information to what is required to ensure accurate service. Most of the information we collect is very basic and is needed to complete a purchase or provide a refund. Examples of user information that may be collected may include your name, address, telephone number, e-mail address, credit-or debit-card information, a description of the item requested or purchased and the IP address of your computer.

The purpose of processing personal data
The purpose of processing personal data is provided by the customer is the realization of purchase of goods.

Legal basis for processing of personal data
The legal basis for processing of personal data provided by the customer is the fulfilment of obligations arising for the Controller from the concluded purchase contract (this is, for example, the obligation of the Controller to hand over the ordered goods to the customer) and from legal regulations (this is, for example, the obligation of the Controller arising from for him from the legal regulations on the mandatory archiving of personal data) and further the legitimate interest of the Controller represented by the enforcement of any legal claims arising from the Controller against the customer in connection with the purchase of goods, including the enforcement of any claims of the Controller against the customer by extrajudicial means.

Embedded content from other websites
Customer agrees that MNX may include in promotions other embedded content (YouTube for example). Embedded content from other websites behaves in the exact same way as if you visited those websites. These websites may collect your data, use cookies and monitor your interaction with their embedded content.

Who do we share your data with?
We do not share your data with any other third-parties in any way (other than the joint controller, the Cartfox provider). We respect your privacy and act in that manner.

For how long do we retain your data?
We save data for only as long as required to fulfil the purpose for which it was collected and, if applicable, for a period of mandatory archiving of personal data.

How do we protect your data?
We use a variety of technical and organizational security measures, including encryption and authentication tools, to maintain the safety of your personal information.

What rights do you have over your data?
The customer has the right to request from the Controller access to and rectification or erasure of personal data or restriction of processing concerning the data subject or to object to processing as well as the right to data portability. In more detail, these rights are regulated in Articles 15 – 20 GDPR.

The customer has the right to lodge a complaint with a supervisory authority.

Where the processing is based on the customer’s consent to the processing, customer has the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

If you are registered on our Website, you can always request to receive an exported file of the personal data that our Website holds. You can also delete your profile with personal data or request for deletion of that data on info@mnxsportswear.com (you should write us from the e-mail address that you want to be deleted from our data base). We can delete all the data except the basic data that was needed for administrative purposes and has to be stored (for example, data that is entered to create an invoice of purchased items).

 

The requirement to provide personal data
The requirement to provide personal data provided by the customer is based on the law, the contract of purchase and the requirement that must be included in the contract of purchase. Assuming that the customer wants to conclude a purchase contract with the Controller, he is obliged to provide personal data to the Controller. If the customer did not provide the provided personal data to the Controller, the Controller could not e.g. fulfil its obligations under the purchase contract and legal regulations arising from it. The requirement to provide the customer’s identification data is also necessary for the conclusion of the purchase contract. If these personal data, i.e. the identification data of the customer, are not provided, it would not be possible to conclude the purchase contract at all.

 

1. E-MAIL ADDRESSES AND OTHER DATA
We collect e-mail addresses and other personal data that our customers entered when ordering or registering on our Website. The only data that can be later used is email address that is used by MNX for promotion purposes only and is not handed to third-parties. We use only those e-mails that our customers entered by their own decision. For email promotions we use Sendy service. Sendy service saves customer’s IP address in order to prevent data abuse. Sendy also saves click rates in statistic purposes only. This data is never used for other purposes and our customers are not being followed elsewhere. Customers can always delete their e-mail address from our email list by clicking on a link that is added in promotion emails.

 

2. SMS NOTIFICATION
The controller uses Cartfox for sending electronic messages to individuals (SMS, instant messaging applications, e-mails). The Cartfox Privacy Policy and information about the Cartfox provider are available here. The controller manages personal data together with the Cartfox provider.

Personal data of individuals processed within Cartfox include:

  • e-mail address;
  • telephone number;
  • information about the Website or application through which the e-mail address and/or telephone number was provided;
  • information about the sending of the messages:
    • message type (SMS, instant messaging application (type of application), e-mail);
    • the date of sending;
    • time of sending;
    • the content of the message sent (e.g., abandoned cart, discount notification, etc.);
  • information about an undelivered message (the date and time of receipt of the undeliverability notification);
  • information about the performed action (e.g., purchase of an item in the abandoned cart, purchase of a discounted item, etc.).

Personal data (e-mail, phone number) are transferred automatically to the joint controller, the Cartfox provider, when an individual provides the data on the Website or within the Controller’s application.

The legal basis for processing of personal data when using the Cartfox service is:

  • the consent of the individual (for recipients who consented to receiving messages);
  • the Controller’s legitimate interest (for recipients who have not consented to receiving messages).

Each message received contains easy unsubscribe instructions. By unsubscribing, the recipient only unsubscribes from receiving Cartfox messages. If you wish to unsubscribe from all communications sent by the controller, you can contact us at sales@dfvu.org.

The purpose of processing personal data within Cartfox is to encourage recipients to purchase products or services on the website or in the controller’s application, or to verify their willingness to enter into a contract (e.g., in the case of abandoned cart messages).

Personal data collected within Cartfox are not disclosed to third parties (other than the joint controller, the Cartfox provider) and the controller has no access to them. Within Cartfox, the controller can only access reports including aggregated and thus anonymized data (e.g., the number of messages sent, the number of purchases via messages sent, etc.).

Personal data processed within Cartfox are not transferred to third countries or international organizations, which means they are not transferred or exported outside the territory of EU Member States.

Information about the retention period of the personal data processed within Cartfox, about the protection of such personal data, and about the rights of individuals relating to their personal data is available in the CARTFOX Privacy and Personal Data Protection Policy. 3. COOKIES AND STATISTICS
All our Website tools and extensions are used only for Website purposes and are not handed to third-parties.
Google Analytics: mnxsportswear.com uses Google Analytics to track and report Website traffic and behaviour.
Facebook Pixel: mnxsportswear.com uses FB Pixel to track Website conversions.
WordPress logged-in cookies: These cookies are used by WordPress to authenticate logged-in visitors, password authentication and user verification.
WooCommerce cookies: Cookies are used by WooCommerce plugin to track visitors and their purchased items in the shopping cart.WooCommerce conversion tracking: This tool helps to track login, checkout and registration success of a customer.
Credit card and PayPal plugin: When customer orders and chooses payment options PayPal or Credit Card, we may use customer’s personal information to prevent potential fraud. For this purpose, we may need to share customer’s personal information with our credit rating providers. This is necessary for the purposes of our legitimate interests in ensuring we are not the victim of fraud and to protect our legal rights set out in the Terms and Conditions.
